These Terms of Service ("Terms") govern your use of the Driver Engage mobile app and web dashboard (together, the "Service") operated by Driver Engage. By using the Service you agree to these Terms.
1. Who can use the Service
- Companies create an account, manage drivers, and are responsible for the accuracy of the driver data they upload.
- Drivers use the mobile app by redeeming an invite code issued by their Company.
2. Your account
You are responsible for activity that happens under your account and for keeping your sign-in credentials secure. Notify us immediately if you suspect unauthorized access.
3. Acceptable use
You agree not to:
- Use the Service to send unlawful, harassing, or misleading content.
- Attempt to access another Company's data or another driver's account.
- Reverse engineer, scrape, or interfere with the Service.
- Use the Service in violation of applicable transportation, employment, or privacy laws.
4. Driver content & rewards
Driver replies, survey answers, and redemption requests are shared with the driver's Company. Points and rewards are issued and fulfilled by the Company. Driver Engage is not the seller or fulfillment provider of any reward and makes no warranty as to availability, delivery, or value of rewards.
5. Push notifications
You consent to receive scheduled engagement and survey notifications. You can disable them at any time in your device settings or by deleting your account in the app.
6. Subscription & fees
Use of the Service by Companies may require a paid subscription. Pricing and billing terms, if applicable, are agreed separately with the Company.
7. Termination
You may stop using the Service at any time. Drivers can delete their account directly in the app. Companies can request workspace deletion by emailing support. We may suspend or terminate access for violations of these Terms.
8. Disclaimers
The Service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, Driver Engage and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms is limited to the amounts paid by you (if any) to Driver Engage in the 12 months preceding the claim.
10. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes to the Terms will be announced in the admin dashboard, and your continued use after the effective date constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Iowa, USA, without regard to its conflict-of-laws principles.
